Churchill Cloud – Terms of Service

At Churchill Cloud, privacy is not just a feature—it is the foundation of our mission. We own our data centers and software, ensuring complete control over security, infrastructure, and user privacy.

You agree to these Terms of Service ("Terms") by using Churchill Cloud.

⚠️ Note: The actual terms of any agreement will be set at the time of service purchase. This document provides a general framework for Churchill Cloud's policies and commitments.

1. Acceptance of Terms

By creating an account or using Churchill Cloud, you acknowledge and agree to these Terms. If you disagree, you may not use our services.

2. Our Service & Mission

Churchill Cloud provides a privacy-first cloud infrastructure emphasizing data sovereignty, security, and freedom from external control.

We do not monitor, analyze, or monetize user data. We aim to provide a neutral, censorship-resistant, and secure computing environment.

3. Account Registration & Responsibility

Users must provide accurate and lawful information when registering.
Users are responsible for securing their account credentials. Churchill Cloud is not liable for unauthorized access due to weak passwords or user negligence.
Users are responsible for all activity under their account.

4. Acceptable Use Policy

To maintain legal compliance and the integrity of our platform, users may not use Churchill Cloud to engage in or facilitate:

Illegal activities include but are not limited to fraud, hacking, money laundering, or human exploitation.
Content that violates applicable laws regarding criminal acts or legally recognized harm to others.
Attempts to compromise Churchill Cloud's infrastructure include DDoS attacks, unauthorized access attempts, or abuse of resources.

⚠️ Churchill Cloud does not monitor user data, but we reserve the right to act upon clear legal violations when required by law.

5. Data Ownership & Security

You own your data. Churchill Cloud does not access, track, sell, or share user data.
End-to-End Encryption (E2EE): All data is encrypted in transit and at rest. Churchill Cloud does not store encryption keys.
No Backdoors: There is no hidden access for third parties, governments, or corporations.
User-Driven Data Deletion: Users can permanently delete their data at any time, which cannot be recovered.

6. Service Availability & Limitations

We strive for 99.99% uptime, but occasional downtime may occur due to maintenance or unforeseen circumstances.
Churchill Cloud is not responsible for outages caused by force majeure events, including natural disasters, cyberattacks, or government interference.

7. Payments, Subscriptions & Refunds

Billing: Users agree to pay for their selected plan in advance.
No Refunds: Payments are final unless there is a verified billing error.
Cancellation Policy: Users may cancel at any time. Upon cancellation, data is permanently deleted and cannot be restored.

8. Disclaimers & Limitation of Liability

Churchill Cloud is provided "as is" and "as available" without warranties of any kind.
No liability: Churchill Cloud is not responsible for data loss, cyberattacks, or legal consequences arising from user actions.
No absolute immunity: While we prioritize security, no system can be 100% invulnerable. Users assume their own risk when using the service.

9. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Colorado without regard to conflict-of-law principles.
Any disputes must first be attempted to be resolved through Churchill Cloud's support team.
If unresolved, disputes shall be settled via binding arbitration in Colorado, waiving class-action lawsuits.

10. Changes to These Terms

Churchill Cloud reserves the right to update these Terms at any time.
Users will be notified of significant changes before they take effect.
Continued service use after an update is accepted by the revised Terms.
